Deuce Privacy Policy

For the purposes of this Privacy Policy the data controller is Deuce Tennis Limited, a company incorporated in England and Wales, company number 08491830, whose registered offices are situated at 4 Rawmec Business Park, Plumpton Road, Hoddesdon, Herts, England EN11 0EE (Deuce). Details of our notification to the data protection regulator may be found in the Information Commissioner’s Office Public Register of Data Controllers at www.ico.gov.uk under registration number ZA322503.

To the extent that we determine the manner and the purpose of processing, we acknowledge that we are a Data Controller of your Personal Data and/or Sensitive Personal Data (which, on and from 25 May 2018, shall have the respective meanings given under the General Data Protection Regulation (EU) 2016/679) (the “Regulation”)). We undertake to act in accordance with the Regulation and any additional applicable laws at all times.

  1. Why do I need to read this Policy?

    1. We take your privacy seriously and this policy (Privacy Policy) sets out how we will handle your personal data securely and in accordance with your rights. We want to you to enjoy using our app, but as a responsible organisation, we also want to make sure that you know your rights and are in control of the information you share with us. So that we can honour our commitment to be as transparent as possible, we have put together this policy which tells you:

      • what information we might collect about you when you download the Deuce app or visit our website

      • how we might use that information

      • when we might use your details to contact you

      • how we use your information in the app

      • what information of yours we might share with others

      • your choices about the personal information you give us

    2. We will regularly review the purposes for which we hold your Personal Data and will not hold it for longer than is necessary. We will also seek to minimise the Personal Data, which we hold about you wherever possible. If we intend to make use of your Personal Data for any new purposes which would be considered incompatible with the purposes for which it was originally collected, as set out in this Privacy Policy, we will notify you of such intended uses and seek your consent to such activities, prior to the commencement of any such processing.

    3. Please note that in order to access some of our services and functionalities of the app, we may need to collect Personal Data from you in order to provide such services. Where we need information for such purposes we will make this clear to you.

  2. What information do you collect from me?

    1. When you register to use our app and/or our sites we may ask you to provide certain information such as your name, address, email address, and contact number as well as details of your ‘emergency’ contact person. We may also collect information on an on-going basis about how often you log into the app, and information about how you use our app, for example the in-app services you most use, what features of the app you enjoy most, how long you stay logged into the app, interactions with other app users and changes you make to information you supply to us. If you contact us, we may keep a record of that correspondence.

    2. When you download or access the app we will ask for your name and contact details, your date of birth and email address as well as a contact number so that you can take advantage of the app’s features and find the right facilities, coaches and fellow app users for you. If you want to you can also upload a photo for your profile picture, but that is up to you and if you don’t want a photo of yourself you can leave it out.

    3. We also automatically collect some technical information from these devices and web browsers such as IP (internet protocol) address, device ID and app ID. We collect this to understand how you use your app, who we can improve it and how to make the services we provide to you better.

    4. In order to provide you with some of our services, we may need to collect Personal Data which is defined as ‘sensitive’, such as your medical data. We will ask you to signify your explicit consent to such Sensitive Personal Data being processed by us whenever we collect such information from you and the provisono of such informaiotn is viluntaruly. Usually we would only ask for this type of information if you had specific needs such as facilities that are wheelchair friendly etc, or to meet any other additional needs that you may have. We don’t use this informaiton for any other purpose, unless there is an exceptional circumstance (for example law enforcement). We just want to make sure that you really enjoy your activities and that everyone can join in.

  3. Why does Deuce use my information?

    1. Personal information makes our app work; we need it so we can tailor the app to your needs. We’ve set out below the main reasons why we use your data so that were clear about why we process it:

      We process your information for the following purposes to fulfil our contract under the app with you:

      • in the normal course of our services, to allow us to register you to receive our services and to provide you with our services

      • to deliver and find you local sports facilities, trainers and fellow players

      • to allow us to manage your account(s)

      • to store your details when you return to our app or sites, which includes things like details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data and the resources that you access on the basis that processing is necessary in order to perform our contract with you to provide our services.

      We also make use of your details for purposes, which are in our general business interests and allow us to perform our goods and services:

      • to allow us to analyse your personal preferences and personalise our services to you so that we can provide a more tailored experience to you, for example we use geo-location so that we show you facilities in your local area

      • to validate your Personal Data (and, in some cases, match it against information that has been collected by a third party) to check that the Personal Data we hold about our users is accurate, consistent and up to date on the basis that you have consented to such processing by agreeing to share your Personal Data with us for such purposes

      • developing and/or consolidating our ventures and interests, as well as defending our legal rights and/or seeking advice from our professional advisors

      When we process your personal information for our business interests, we will consider and balance any potential impact on you and your rights under data protection and any other relevant law. Our legitimate business interests do not automatically override your interests – we will not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

    2. We will periodically check that the Personal Data we store for you is accurate. If you would like to update the Personal Data we hold about you, please see [What are my rights?] below.

  4. I’m under 18, can I use Deuce?

    1. When you sign up for the app, we ask for your date of birth so that we can verify your age.

    2. We know that old and young alike love the activities that we offer. But Deuce is aimed at over 18s and we do not currently allow under 18s to access our services. Please be aware therefore that if you are under 18 we will not authorise your account and will investigate thoroughly attempts to circumvent our policy and age gating mechanisms.

    3. Although our services are not aimed at under 18s, as a responsible organisation we will keep our services secure and will always take into consideration the Information Commissioner’s Office’s approach to children’s safety.

  5. Who do you share my information with?

    1. As part of using our services, we may also share your Personal Data with the following parties:

      • service providers and other third parties who process and store data on our behalf

      • professional advisors

    2. We may also share your Personal Data with third parties:

      • in the event that our services, either in whole or in part, are acquired by a third party (in which case Personal Data about clients will be one of the transferred assets)

      • if we are under a legal duty or have a lawful ground, to disclose or share your Personal Data

      • in order to enforce any contract with you

      • to protect our rights, property, or the safety of our employees, clients, constituents or others. This includes exchanging information with other organisations and local authorities for the purposes of fraud, safeguarding and crime prevention.

      Again, we will always undertake a balancing exercise when we undertake such sharing and ensure that third parties with whom we work respect your privacy too,

  6. How long do you store my personal information for?

    1. We only store your Personal Data for as long as necessary for the purposes described in this Privacy Policy.

    2. In any event, we will only store your Personal Data whilst you continue to use our services and for a period of six months thereafter.

  7. Where do you store my information?

    1. In order to ensure fair and transparent processing, we will, taking into account our processing activities, adopt appropriate procedures for the processing of Personal Data, which shall include implementing technical and organisational measures which take into account the harm that may be suffered, and correct inaccuracies identified in Personal Data processed, so that risk of errors are minimised and your Personal Data is processed in a fair and secure manner.

    2. All information you provide to us is stored on our secure servers. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your data transmitted to our app; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

    3. From time to time, service providers and organisations with whom we work to provide services to you or agencies with which we work may be located outside the European Economic Area in countries that do not have the same standards of protection for personal data as the UK. We will, however, always use every reasonable effort to ensure sufficient protections are in place to safeguard your Personal Data. We will also ensure that our service providers enter into compliant processing agreements with us to ensure that your Personal Data is processed in accordance with applicable data protection legislation.

  8. Marketing

    1. From time to time we would like to contact you by in app notification, email, social media and/or text message with details of our services. We will only contact you with regards to details of our services where you have indicated your express consent for us to do so by ticking the relevant box situated in the app.

    2. The provision of Personal Data for the purposes of direct marketing is voluntary and you do not need to provide such Personal Data in order to receive our services.

    3. You can exercise the right to opt-out of receiving such marketing at any time by contacting us at support@deucetennis.com or selecting “unsubscribe” on the relevant marketing communication.

  9. Targeted Ads

    1. The app and the Content may contain advertisements. Deuce** **is not responsible for and does not endorse the content of such advertisements, and does not accept any responsibility for any errors or inaccuracies in such advertising material. The types and extent of advertising on the app and in the Content are subject to change.

    2. Sometimes we may serve adverts in the app, which relate to services and goods offered by our partners, for example we may promote a particular tennis racket supplier who is offering a discount for app members. You will be able to manage your preferences as to whether you see these types of adverts in the app though the user profile settings in the app. These links and promotions are provided for your convenience and interest. It is entirely your decision whether to pursue them. When you use a link to a third party site, you will leave the app. Where you purchase third party products or services, you do so on the terms of the provider, not us. Its therefore important to familiarise yourself with the terms of that third party.

    3. We might also use information that we hold about you (such as your email address) to show you relevant and “targeted advertising” through other companies’ sites, like Facebook, Google, Snapchat or Twitter for example. This could be showing you a Deuce advertising message where we know you have a Deuce account and have used our apps or services. If you don’t want to see our targeted advertising, you can re-set ad preferences in your social media companies’ settings and our app.

  10. What are my rights?

    Subject to our legal requirements and lawful grounds of processing, you have the following rights:

    • Access to your personal data: You may request access to a copy of your Personal Data, by providing details of your request.

    • Right to withdraw consent: You may withdraw your consent to processing at any time, explaining why you wish to do so.

    • Rectification: You may ask us to rectify inaccurate Personal Data held about you by providing the updated information.

    • Erasure: You may ask us to delete your Personal Data, specifying why you would like us to delete your Personal Data.

    • Portability: You may ask us to provide you with the Personal Data that we hold about you in a structured, commonly used, machine readable form, or ask for us to send such Personal Data to another data controller.

    • Right to object: You may object to our processing of your Personal Data by providing details of your objection.

    • Make a complaint: You may make a complaint about our data processing activities to a supervisory authority. For the UK, this is the Information Commissioner’s Office, who can be contacted via ico.org.uk.

    To make enquires and/or to exercise any of your rights in this Privacy Policy please contact support@deucetennis.com. Please note that we may ask you to provide a form of identification verification before we can give effect to any such request made by you and such requests will always be subject to our legal obligations and lawful grounds of processing.

  11. IP addresses

    We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.

  12. Links to Other Websites

    Our site and app may, from time to time, contain links to and from the websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any Personal Data to these websites. As noted above this can include links to third parties whose adverts have been served via the app. If you want to know more abou those Third Party Ads, please read section 9 above.

  13. Changes to this Privacy Policy

    1. We may modify this Privacy Policy from time to time, so please review it regularly.

    2. If we change this Privacy Policy in a way that may substantially alter the purposes for which we process your Personal Data we shall notify you by means of notice on our site homepage, the app landing page and where a material change to such terms, by email to the email address you have provided to us.
